MAN CONVICTED FOR ATTACKING GOOD SAMARITAN AT STATELINE

 

On September 18, 2018, in an after-hours verdict a South Lake Tahoe jury found Scott David Fitzgerald of Elk Grove California, guilty of felony assault by means of force likely to produce great bodily injury; Penal Code §245(a)(4).

The conviction stems from an attack that occurred on November 12, 2016, in the area of Stateline. On that date, Fitzgerald was witnessed verbally harassing women while exiting Harrah's casino around 2:30 a.m. During the exchange, Fitzgerald was also witnessed throwing the contents of a beer onto one of the women. A bystander checked on the women and approached Fitzgerald. Witnesses testified that Fitzgerald and his friend then "jumped" the victim. Fitzgerald was also seen kicking the victim in the area of his face. The victim suffered serious injury including an orbital fracture, 2 avulsed teeth and lacerations that required suturing.

Judgment and sentencing has been set for October 29, 2018, in South Lake Tahoe. The case was investigated by the South Lake Tahoe Police Department and prosecuted by Deputy District Attorney Casey Mandrell.
